Gather Reporter Contest Official Rules  

NO PURCHASE NECESSARY TO ENTER OR WIN.  

1. How to Enter: To submit your application to become a Gather Reporter (“Contest”), please do the following:

·       Register on Gather.

·       Complete the application form at jaworldwide.org/gather-reporter

·       If the application asks you to upload content, use the online storage of your choice (for example Dropbox, Google Drive, etc.) and share the link in the space provided on the form at jaworldwide.org/gather-reporter.

All entry information, videos and blog posts shall be collectively referred to herein as the “Submissions” or each as a “Submission.”Submissions must comply with the Guidelines and Restrictions defined below. JA Worldwide (“Sponsor”) reserves the right to cancel or modify this Contest in the event an insufficient number of entries are received that meet the minimum judging criteria. Limit of one Submissions per person/per email address.

By submitting an application and agreeing to the Guidelines and Restrictions, the creator of each Submission (“Entrant”) warrants and represents the following with respect to their Submission: (a) Entrant is the sole and exclusive owner of the Submission; (b) the Submission is Entrant’s own creation and is 100% original; (c) the Submission will not infringe on any rights of any third parties; and (d) any third parties appearing in the Submission have given Entrant appropriate consent to be filmed and their likeness used pursuant to the JA Worldwide Privacy Policy and Terms of Use. Sponsor reserves the right to request third party releases from any third party included in any Submission at any time. Failure to produce fully executed third party releases (if applicable) may result in disqualification of the Submission, in Sponsor’s sole and absolute discretion. 

Submission of Personal Data:

Providing a Submission constitutes Entrant’s consent to grant Sponsor a nonexclusive, worldwide, royalty-free, perpetual, non-revocable license to use the content in connection with the Contest, including, without limitation, the rights to distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat the content and to publish Entrant’s name in connection with the content. Entrant acknowledges and agrees that Sponsor may preserve the content and may also disclose the content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these terms; (c) respond to claims that any content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of JA Worldwide, our agents and employees, our users, and the public. Entrant’s understand that the technical processing and transmission of the website, including Entrant’s content, may involve numerous transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices.

By submitting the Gather Reporter application form, Entrant acknowledges and consents to the JA Worldwide Privacy Policy and the JA Worldwide Terms of Use. Entrant also acknowledges and agrees that the personal data shared in the form has been shared freely, and understands that the personal data will be used when selecting the Gather Reporters. Furthermore, Entrant acknowledges that, if selected, Entrant will be required to agree to all applicable JA Worldwide policies.

Special Admonitions for International Use:

Recognizing the global nature of the Internet, all Entrants agree to comply with all local rules regarding online contests or competitions and acceptable content. Specifically, Entrant agrees to comply with all applicable laws regarding the transmission of data exported from the United States or the country in which Entrant resides.

All Entrants must have a valid email address. No automated entry devices and/or programs permitted. All data contained in Submissions becomes the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, postage-due, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human, or electronic. Only fully completed entry forms are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.  

2. Start/End Dates: Contest begins at 12:01 AM Eastern Time on Friday, April 8, 2022 and ends at 11:59:59 PM Eastern Time on May 8, 2022. No entries will be accepted after 11:59:59 PM Eastern Time on May 8, 2022. 

3. Eligibility: Participation open only to alumni who have gone through at least one JA program. Void where prohibited. Employees, officers, and directors of Sponsor and its parent company, subsidiaries, affiliates, partners, advertising and promotion agencies, manufacturers, or distributors of Contest materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter. All applicable laws and regulations apply. 

4. Submission Guidelines and Content Restrictions: By entering, each Entrant agrees that his or her Submission conforms to the Submission Guidelines and Content Restrictions (“Guidelines and Restrictions”) as defined below  and the Sponsor, in its sole discretion, may remove any Submission and disqualify an Entrant from the Contest if it believes that the Entrant’s Submission fails to conform to the Guidelines and Restrictions.  

Submission Guidelines:  

  • Entrant must be registered on Gather.

  • All required fields must be completed on the application form at jaworldwide.org/gather-reporter, specifying one of the four options. If the application asks you to upload content, use the online storage of your choice (for example Dropbox, Google Drive, etc.) and share the link in the space provided on the form at jaworldwide.org/gather-reporter.

 

Content Restrictions:  

  • The Submission must not contain material that violates or infringes any rights of any other party, including but not limited to copyright, trademark, privacy, publicity or any other intellectual property rights.

  • The Submission must not in any way disparage Sponsor or any other person or party.

  • The Submission must not contain material that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous, or libelous.

  • The Submission must not contain material that promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.

  • The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations of the United States or of any jurisdiction where Submission is created.

  • The Submission cannot promote illegal drugs or firearms (or the use of any of the foregoing), or any activities that may appear unsafe or dangerous, or any particular political agenda or message.

  • The Submission must be consistent with the image and values of Sponsor and be consistent with and satisfy the purpose of the Contest.

  • Submissions cannot violate any applicable Terms of Service (or Terms of Use) of Instagram, YouTube, Vimeo, Weibo, Google, Dropbox, etc.

Each Entrant acknowledges that other Entrants may have used ideas and/or concepts in their Submission that may be similar in idea or concept to what is included in Entrant’s Submission. Each Entrant understands and agrees that he/she shall not have any claim against any other Entrant or Sponsor arising out of any such similarity or be entitled to any compensation because of any such similarity. 

Sponsor’s decisions are final and binding in all matters relating to this Contest, including, but not limited to, interpretation and application of these Official Rules. By entering the Contest, Entrants fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the Contest. 

5. Judging/Judging Criteria: Sponsor reserves the right, in their sole and absolute discretion, to disqualify any Submissions that are inappropriate for any reason, including without limitation, for depicting or mentioning sex, violence, drugs, alcohol, and/or inappropriate language. The Gather Reporters will be selected by May 31, 2021, based on the quality and creativity of answers and uploads requested in the application. JA Worldwide also reserves the right to select fewer than four Gather Reporters due to lack of entries and/or lack of quality entries.

By entering the Contest, Entrants fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the Contest.  

6. Honor: Winners will be chosen as official Gather Reporters for a term starting June 1, 2022, and ending May 31, 2023. Gather Reporters will receive the following benefits:

  • Develop global communication skills as an international storyteller on the Gather team.

  • Interview and connect with inspiring individuals and produce content for JA Worldwide and Gather.

  • Enroll in one professional course at no cost selected by Sponsor.

  • Work with published authors and award-winning marketers and influencers to improve your skills.

  • Receive exclusive Gather Reporter merchandise (maximum US$100 value).

  • Earn an official certificate of participation from JA Worldwide and be able to show your JA Worldwide affiliation on LinkedIn.

Selected Gather Reporters will not receive a salary or stipend and any expenses occurred during the term as a Gather Reporter will be the responsibility of the individual.

Entrants consent to the use of their name, likeness, and entry for purposes of publicity by Sponsor without further compensation, unless prohibited by law.

7. Notification: Winners will be notified by email and may be required to sign and return, where legal, an Affidavit of Eligibility, Liability/Publicity Release within five (5) days of notification. If any winner is considered a minor in his/her jurisdiction of residence, Affidavit of Eligibility, Liability/Publicity must be signed by his/her parent or legal guardian. If the winner cannot be contacted within five (5) calendar days of first notification attempt, if any notification is returned as undeliverable, if the winner rejects his/her selection, or in the event of noncompliance with these Contest rules and requirements, the selection will be forfeited and may be awarded to the Submission with the next highest score. Upon forfeiture, no honor or portion thereof will be given.

8. Conditions: Submissions may be cut, edited, reformatted, rearranged, combined with other materials and/or otherwise modified, in Sponsor’s sole and absolute discretion. Participation in Contest and/or acceptance of selection each winner’s permission for Sponsor to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information, Submission and/or any statements made by each Entrant regarding the Contest or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law.

By participating in the Contest, Entrants, finalists, and the winners agree to release and hold harmless Sponsor and its subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such Entrant’s participation in the contest and/or Entrant’s acceptance, possession, use, or misuse of any honor or any portion thereof. Neither any participation in this Contest nor anything in the rules of this Contest shall create or imply an employment agreement, legal partnership, or joint venture between the Entrant and Sponsor. In addition, no portion of the work product produced by the Entrant involves any projects on a “work-made-for-hire” basis. Each Entrant shall be free to use and employ general skills, know-how, methodologies, algorithms, techniques and expertise in performing any activity the Entrant undertakes as a part of this Contest.

9. Additional Terms: Any attempted form of entry other than as set forth in Section 1 above is prohibited; no automatic, programmed; robotic or similar means of entry are permitted. Sponsor, its affiliates, partners and promotion and advertising agencies are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Contest, including any injury or damage to Entrant’s or any other person’s computer relating to or resulting from participating in this Contest or downloading any materials in this Contest. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Contest should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In such case, Sponsor will select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any Submission it finds to be tampering with the entry process or the operation of the Contest or website. Sponsor may prohibit an Entrant from participating in the Contest or winning a honor if, in its sole discretion, it determines that the Entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Entrants or Sponsor representatives. 

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 

In the event of a dispute as to any Submission, the authorized account holder of the email address used to register will be deemed to be the Entrant and must comply with these Official Rules. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each Entrant may be required to show proof of being an authorized account holder. 

10. Agreement to Conduct Transactions Electronically. Entrant agrees that all transactions regarding the Contest may, at our option, be conducted electronically from start to finish. If Sponsor decides to proceed non-electronically, those transactions will still be governed by the remainder of these terms unless Entrant enters into different terms on a form provided by Sponsor. If the law allows an Entrant to withdraw this consent or if Sponsor is ever required to deal with an Entrant non-electronically, Sponsor reserves the right to charge or increase fees and agrees to print or make an electronic copy of the terms and any other contract or disclosure that Sponsor is required to provide to Entrant.

11. Compliance with Laws. Entrant is responsible for compliance with applicable local laws, keeping in mind that contests of this nature by certain persons or in certain countries may not be legal.

12. No Agency; No Third-Party Beneficiary. No agency, partnership, joint venture, employee-employer, lessor-lessee, or franchisor-franchisee relationship is intended or created by these terms. Neither Entrnat nor Sponsor intends that any third-party will be a beneficiary of or entitled to rely on any part of these terms.

13. Severance. If any part of the terms is held by a court of competent jurisdiction to be invalid or unenforceable, the invalid or unenforceable part will be given effect to the greatest extent possible and the remainder will remain in full force and effect, provided that the allocation of risks described herein is given effect to the fullest extent possible.

14. No Assignment. These terms are personal to Entrant and Entrant may not transfer, assign, or delegate these terms to anyone without Sponsor express written permission. Any attempt by Entrant to assign, transfer, or delegate these terms without Sponsor express written permission will be null and void. Sponsor shall have the right to transfer, assign, and/or delegate these terms to one or more third-parties without Entrant permission.

15. Jurisdiction; Choice of Law; Export Limitations. The website is controlled and operated by Sponsor from offices within the United States of America. Entrants are responsible for compliance with applicable local laws. Entrants may not use or export anything from the website in violation of U.S. export laws and regulations, other applicable laws or regulations, or the terms. These terms and all performances and claims of every nature (including without limitation, contract, tort, and strict liability) relating in any way to any aspect of the website will be governed by the laws of the state of Delaware, USA, without regard to any conflicts of laws principles that would result in the application of the law of a different jurisdiction. Entrants agree to submit to the personal and exclusive jurisdiction of the courts located within the state of Delaware, USA.

16. Limitations on Actions. Any action concerning any dispute Entrants may have with respect to the website must be commenced within one year after the dispute arises, or the cause of action is barred.

17. Paragraph Headings. The paragraph headings in these terms are included to help make these terms easier to read and have no binding effect.

18. Entire Agreement. These terms (including terms incorporated into them, such as the privacy policy), as well as any additional terms or conditions contained on the website for particular activities, and disclosures provided by Sponsor and consents provided by Entrant on the website comprise the entire agreement (the "Entire Agreement") between Entrant and Sponsor with respect to the use of the Submission and supersedes all prior agreements between the parties regarding the subject matter contained herein, and neither party has relied on any representations made by the other that are not expressly set forth in the entire agreement.

19. No Waiver. Sponsor failure to exercise or enforce any right or provision of these terms, including any failure to act with respect to a breach, will not constitute a waiver of such right or provision or our right to act with respect to subsequent or similar breaches. Sponsor suggests that all Entrants print out a copy of these terms for your records.

20. Limitation of Liability; Disclaimer of Warranties: IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANT ACCESS TO AND USE OF THE SERVICE AND/OR THE APPLICATION, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATES WITH THE CONTEST. WITHOUT LIMITING THE FOREGOING, THIS CONTEST AND ALL HONORS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO ENTRANTS. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. 

21. Use of Data: Sponsor will be collecting personal data about Entrants online, in accordance with our privacy policy. Please review the Sponsor’s privacy policy. By participating in the Contest, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy

By participating in this Contest, Entrant agrees to be fully unconditionally bound by these rules and regulations. In addition, Entrant agrees to accept the decisions of the Sponsor as final and binding as it relates to the contest.

ANY VIOLATION OF THESE RULES BY ENTRANT (AT THE SOLE DISCRETION OF SPONSOR) WILL RESULT IN SUCH ENTRANT’S DISQUALIFICATION FROM THE CONTEST AND ALL PRIVILEGES AS ENTRANT OR WINNER WILL BE IMMEDIATELY TERMINATED.
